Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Generato application operated by Zoync Technologies Pvt. Ltd.
1. Accounts
When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
2. Credits
Generato uses a credit-based system for AI generations. Credits can be purchased through our payment processor. Credits are non-refundable except where required by law. Free credits provided upon registration are subject to change without notice.
3. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Generato and its licensors. Models generated by user prompts are governed by standard service and intellectual property terms.
4. Prohibited Content
You agree not to use Generato to create, upload, or distribute any of the following types of content:
- NSFW / Sexually Explicit Content: Nudity, pornography, sexually explicit material, or any content intended to be sexually gratifying.
- Deepfake / Impersonation Content: Non-consensual manipulation of a person's likeness, face-swapped imagery, celebrity impersonation, or any AI-generated content designed to deceive viewers about the identity of depicted individuals.
- Violence & Gore: Graphic depictions of violence, mutilation, torture, or content that glorifies or promotes violence.
- Child Safety Violations: Any content depicting or exploiting minors in any way.
- Harassment & Hate Speech: Content intended to harass, bully, intimidate, or promote hatred against individuals or groups.
Generato employs automated content moderation systems to detect and prevent the generation of prohibited content across all workflows including text-to-3D, image-to-3D, and web image search. Attempting to circumvent these safeguards (including but not limited to obfuscation, encoding, or indirect prompting) is a violation of these Terms.
5. Content Moderation & Enforcement
We use automated moderation tools to screen all text prompts and images before they are processed by our AI generation pipelines. Content that violates our policies will be rejected and not processed. We reserve the right to:
- Reject any prompt or image that triggers our content moderation systems, and keep blocked images privately for up to 180 days for review, as described in our Privacy Policy.
- Suspend or terminate accounts that repeatedly attempt to generate prohibited content.
- Review and remove any previously generated content that is found to violate these Terms.
- Report illegal content to the appropriate authorities where required by law.
6. User Responsibility
You are solely responsible for ensuring that all prompts, images, and other content you provide to Generato comply with these Terms and all applicable laws. You represent and warrant that:
- You have the right to use any images you upload and that they do not infringe on any third party's rights.
- You will not attempt to generate content depicting real individuals without their explicit consent.
- You will not use Generato to create misleading, deceptive, or fraudulent content.
- You understand that violation of these terms may result in immediate account termination without refund.
7. Limitation of Liability
In no event shall Generato, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
8. Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
